1 – Definitions and Parties

  • Client refers to the person or entity engaging Millynn Homes Pty Ltd for services.

  • Contractor, we, us, or our refers to Millynn Homes Pty Ltd.

  • Services refers to any carpentry, decking, pergola, framing, cladding, internal carpentry, or related construction work provided by us.

  • Site refers to the location where the work is to be performed.

2 – Scope of Work and Quote Validity

  • All work to be performed will be detailed in a written quote or proposal which outlines the scope, specifications, materials, and requirements.

  • Quotes are valid for 30 days from the date of issue unless stated otherwise.

  • Any work requested outside of the original scope will be treated as a variation and may incur additional costs.

  • Variations must be agreed to in writing before additional work begins.

3 – Payment Terms

  • A deposit may be required before commencement of work. The deposit amount will be specified in the quote.

  • Remaining payments are due as per the schedule outlined in the quote or agreement.

  • Payments must be made by the due date specified. Late payments may result in delays or suspension of work.

  • If material costs change before purchase, we reserve the right to update the quote and notify the Client.

4 – Timeline and Delays

  • Estimated start and completion dates will be outlined in the quote or agreement.

  • We will take reasonable steps to complete works within the agreed time frame.

  • We are not responsible for delays caused by weather conditions, supply chain disruptions, changes requested by the Client, limited site access, or other circumstances outside our control.

  • Extensions of the timeline may be required in such circumstances.

5 – Access to Site and Client Responsibilities

  • The Client must provide safe and reasonable access to the site for the duration of the project.

  • The Client is responsible for ensuring that all necessary approvals, permits, or permissions are obtained before work begins.

  • The Client must inform us of any known hazards or site conditions that may affect the work.

6 – Warranties and Workmanship

  • All services will be carried out with due care, skill, and in accordance with relevant building standards and codes.

  • Materials supplied by us will be new unless otherwise agreed.

  • The Client must notify us of any defects in workmanship within 7 days of completion.

  • We will assess and rectify any confirmed defects caused by our workmanship within a reasonable time frame.

7 – Variations and Additional Works

  • Any changes to the agreed scope of work must be documented and approved by both parties.

  • Variations may affect the cost and time required to complete the project.

  • If additional work is requested without formal approval, the Client may be charged for extra labour and materials.

8 – Cancellation and Termination

  • If the Client cancels the project before work begins, any deposit paid may be retained to cover costs incurred.

  • If the Client cancels after work has commenced, payment for completed work and materials purchased will be required.

  • Either party may terminate the agreement if the other party commits a material breach. Written notice is required.

9 – Liability and Insurance

  • We carry appropriate insurances for the services provided.

  • We are not liable for indirect, consequential, or financial loss resulting from delays, defects, or interruptions beyond our control.

  • The Client is responsible for ensuring they have adequate home or site insurance for their own protection.

10 – Dispute Resolution

  • If a dispute arises, both parties agree to attempt to resolve the matter through good faith discussions.

  • If a resolution cannot be reached within 14 days, the matter may be referred to mediation or other appropriate dispute resolution processes.

11 – Privacy and Client Information

  • Personal information collected from the Client will be used only for the purpose of delivering the agreed services.

  • We do not share or disclose personal information to third parties unless required by law or with the Client’s consent.

12 – Governing Law

  • These Terms and Conditions are governed by the laws of the Australian Capital Territory.

  • Any legal proceedings must be initiated within the ACT jurisdiction.

13 – Acceptance of Terms

  • By accepting a quote, signing an agreement, or instructing us to commence work, the Client acknowledges and agrees to these Terms and Conditions.

  • These Terms and Conditions apply to all projects undertaken by Millynn Homes Pty Ltd unless otherwise agreed in writing.
